By accessing www.sploot.tech or store.sploot.space  (“Website”) or downloading our mobile application (“App”), you are granting your irrevocable consent to the terms and conditions described in this policy.


Sploot Private Limited (“Company”) is committed to respecting and protecting the privacy of its customers and has accordingly prepared this privacy policy (“Policy”) keeping in mind the provisions of applicable law and privacy by design construct with respect to the data obtained from you.


  • PURPOSE OF THIS POLICY

  • Your privacy is important to us. The purpose of this Policy is to inform you of how the Company collects, uses, discloses and manages your data in connection with the services offered by the Company. The aim of this Policy is to create a relationship of trust between you and the Company. Please take a moment to read this Policy so that you know and understand the purposes for which we collect, use and disclose your personal data. It also tells you how you can access and update your information and make certain choices about how your information is used. 


  • SCOPE OF THIS POLICY 

  • By interacting with us, submitting information to us or signing up for any promotions or services offered by us, you agree and consent to the Company, its related corporations and affiliates (collectively referred to hereinas “Sploot”, “us”, “we” or “our”), as well as our respective representatives collecting, using, disclosing and sharing amongst themselves your personal data, and disclosing such personal data to Sploot’s authorized service providers and relevant third parties in the manner set out in this Policy. 


    For avoidance of any doubts, this Policy forms part of the Website and App terms and conditions (“Website Terms”). In the event of any conflict, inconsistency, or conflict between this Policy and Website Terms, the Policy shall prevail. All defined terms in the Website Terms shall apply to this Policy unless otherwise specifically stated. 


    The Policy covers both “online” (e.g., Website Services and mobile Services, including any Websites operated by us such as https or mobile application, however accessed and / or used, whether via personal computers, mobile devices or otherwise) and “offline” (e.g., collection of data through mailings, telephone, or in person) activities owned, operated, provided, or made available by the Company. The Company empowers pet parents to take better decisions regarding the health, safety, and lifestyle of their pets. The App enables you to organize the pet's health record, manage their tasks and provide personalised recommendations for every pet including without limitation organizing video consultations with various recognized pets (collectively referenced as the “Services”). This Policy also applies to your use of interactive features or downloads that: (1) we own or control; (2) are available through the Services; or (3) interact with the Services and post or incorporate this Privacy Policy. BY ACCEPTING THE WEBSITE TERMS AND CONDITIONS, YOU AGREE TO THE TERMS OF THIS PRIVACY POLICY. Please review the following carefully so that you understand our privacy practices. 


  • AMENDMENT TO THIS POLICY

  • The internet is an evolving medium. The Company reserves the right to change or modify this Policy at any point of time to make it compliant with the technology, relevant applicable law(s) or any such variant. Any changes we make will be effective immediately on notice, which we may provide by posting the new policy on the Website and/or the App. We will not be under any obligation to notify you of any changes to this Policy except if the changes made in this Policy significantly affects your rights or as may be required under applicable law. We may also make reasonable efforts to inform you via electronic mail. Subject to your rights at law, you agree to be bound by the prevailing terms of this Policy as updated from time to time on our Website and/or App. In any case, you are advised to review this Policy periodically on the Website and/or the App to ensure that you are aware of the latest version.

  • The Company collects data/information in various forms such as facts, concepts, opinions or instructions on the basis of user’s action including:

  • The Company collects following types of data (“Information”) as provided by you through your use of our digital platforms in any form including the Website and App:


    Personal Information” which means and includes Information that can be associated with you or could be used to identify you including (a) your name, age, sex, work experience, skills, photos, city or areas, address, trait, attribute; (b) your internet connection, the equipment you use to access the services provided by us and your usage details; or (c) any other information or combination of different information which can identify you.


    We may ask you to provide us with the above mentioned Personal Information and collect this Information through various means and in various places through our services, including creation of any account, contact us forms, or when you otherwise interact with us. We shall ask you to provide only such Personal Information which is for lawful purpose connected with our services and necessary to be collected by us for such purpose. We do not use your Personal Information other than to administer services through the Website and/or the App. We may combine the information that you provide and submit with information from other services and/or third parties in order to provide you with a better experience and to improve our quality of services. 


    We may disclose or share non – personal or anonymous Information or aggregated Information with third parties, such as usage statistics of our Services or IP addresses. Aggregated non-personally identifiable Information is information recorded about users and collected into groups so that it no longer reflects or references an individually identifiable user. These third parties may collect information when users visit our Services. These third parties may use this aggregated information about your visits to this and other websites in order to provide advertisements on the other websites and other forms of media about goods and services of interest to you.

  • Usage Information and Information from Cookies 

    1. In addition to the Information that you choose to submit to us, we and/or our third-parties may use a variety of technologies that automatically (or passively) collect certain information whenever you visit or interact with our Website and/or App (“Usage Information”). This Usage Information may include the browser that you are using, the uniform source locator (“URL”) that referred you to our services, all of the areas within our Services that you frequently schedule logistics to and from, and the day of the week/month, among other information. The Usage Information may include information such as your Internet Protocol (“IP”) address, browser type, browser language, date and time of your request, search terms and may include a domain name and the date and time for each page you view. We also collect the name of and information about any advertisement or other link that brought you to us. This information does not personally identify you. We use IP addresses to diagnose problems with our servers and to administer our website. Your IP address also is used by us to gather broad demographic information, such as your general geographic location and internet service provider. IP addresses are further used to help determine the number of our users to maintain efficient administration of our Services. This demographic information may also be used by us to analyze aggregate usage behavior.

In addition to the above, the Company, and third-parties with whom the Company may have business association with, may use cookies, beacons, pixel tags and similar files or technologies (“Assistive Technology”) to collect and store information in respect to your use of our services and third-party websites. Such Assistive Technology helps the Company to recognize you when you visit our website, collect your preferences and enhance your user-experience by delivering content and advertising specific to your preferences and interests. It also helps us to conduct research pertaining to the improvement of our services based on user-experience and helps us in keeping your Information secure. If you do not wish for your Information to be collected through the use of cookies, your browser allows you to deny  or accept the use of cookies. Cookies can be disabled or controlled by setting a preference within your web browser or on your Device. If you choose to disable cookies or flash cookies or any such Assistive Technology on your Device, some features of the Services may not function properly or may not be able to customize the delivery of information to you. The Company cannot control the use of cookies (or the resulting information) by third parties and use of third party cookies is not covered by our Policy. 

     

    1. Further, we wish to inform you that, while your web-browser and/or device may allow you to modify and/or disable some of Assistive Technologies used by us, however, doing so may interfere with your experience of the services offered by us.  

  • Location

  • The Company also receives information about your network and device when you use our services. However, the Company will ask you to opt-in before we use GPS or other tool to identify your precise location.


  • Messages

  • Additionally, the Company also collects information about you whenever you use our service to send messages to third-parties or contact us with the help of our contact tab.


  • Third-Party Use of Cookies and Other Tracking Technologies.

  • Our Website and/or App may also host third-parties in relation to our services including advertisements and content creation. Such third-parties may collect and/or process your Personal Information. The conduct of such third-parties is subject to the privacy policies and/or terms of use of such third-parties and neither the Company, nor any of its directors, employees or affiliates are responsible for technology hosted or used by such third-parties. We advise you to conduct an independent review of the privacy policy(ies) of such third-party. Further, any queries regarding the privacy policy(ies) of such third-parties must be directed to the concerned third-party. 


  • Information collected by the App and Permissions required by the App

  • We also provide our services through the App. In relation thereto, we  may collect and use technical data and related information, including but not limited to, technical information about your mobile phone and/or tablet (“Device”), system and application software, and peripherals, that is gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to such mobile applications. 


    When you use your App, the App may automatically collect and store some or all of the following information from your Device including but not limited to: (a) Your preferred language and country site (if applicable); (b) the manufacturer and model of your mobile device; (c) Your Device operating system; (d) the type of mobile internet browsers you are using; (e) Your geolocation, (f) information about how you interact with the App and any of our Websites to which the App links, such as how many times you use a specific part of the mobile application over a given time period, the amount of time you spend using the App, how often you use the App, actions you take in the App and how you engage with the App, (g) information to allow us to personalize the services and content available through the app.


    We shall require only the following permissions from your Device to facilitate the services


    1. SMS used to improve the user experience through auto-filing of the OTP for faster sign-up / login experience and other additional services; 

    1. Location permission used for accessing location of the user to improve user experience; 

    1. Contacts permission used to improve use experience for e.g. sharing details of the service to contacts; and 

    1. Call permission used for calling the service partner from the application.  

  • INFORMATION PERTAINING TO MINORS

  • Our services (including the Website and the App) are not intended for individuals under Eighteen (18) years of age. No one under age Eighteen (18) may provide any personal information to the Company. The Company shall not, knowingly, collect Information from individuals under age Eighteen (18). Provided that if the Company learns that it has collected or received Information from an individual under Eighteen (18) years of age without verification of a valid consent from at least One (1) parent or guardian or such an individual (as the case may be), the Company will delete such Information.


  • TERMS OF USUAGE AND DISCLOSURE OF INFORMATION

  • The Company may use, store or process (“Process”) your Information in connection with the services being offered by the Company and such Processing shall be in connection with:

    1. the development, security and/or integrity of the Company’s business, Website, App including any content hosted by the Company including targeted advertisement;
    1. provision of any information, product(s) or service(s) that you may request from us;
    1. maintenance and security of your account and/or Information;
    1. enforcement of any of our rights or in pursuance of any of our obligations arising from any contract or quasi-contract entered into between you and the Company or the Company and any third-party, including rights and obligations in relation to billing and collection;
    1. your participation with the interactive features on our Website/App including but not limited to displaying your personal information on your account or profile page or elsewhere according to your preferences;
    1. any other purpose provided your prior consent is taken in respect of such purpose.

    Any Information collected shall only be used as permitted by law and subject to the terms of this Policy. 


  • Disclosure of Information

  • For the purposes of this Policy, “disclosure of Information” means voluntary transfer (whether absolute or otherwise) of any Information obtained by the Company to a third-party; provided that such third-party shall not include (i) any affiliate, subsidiary or holding entity in relation to the Company; or (ii) any entity capable of seeking or enforcing such transfer by virtue of operation of applicable law; provided further that it is hereby clarified that the term “voluntary transfer” does not include access gained in respect of the concerned Information by third-parties (i) without the specific written consent of the Company; and (ii) irrespective of the validity of the means employed by such third-party to gain such access.  


    Your Information is important for the Company. Therefore, any disclosure of Information by the Company to a third-party, including its contractors, affiliates, and/or business associates, shall be (i) in accordance with and subject to applicable law, the Company’s legal rights and the extant policy of the Company governing such disclosure; (ii) in connection with the services offered by the Company; and (ii) under contractual non-disclosure and confidentiality obligations governing such disclosure to third-parties (where applicable); or (iii) in pursuance of specific consent obtained from you by the Company.


    Besides the foregoing, if we become involved in a merger, acquisition, or any form of sale of some or all of our assets, we will provide notice if such a transaction results in your information being subject to a different Policy. 


  • USER’S RIGHTS AND CHOICES

  • The Company endeavors to provide all our users with choices regarding their Information and privacy. The following sections of this Policy are mechanisms created to provide you with the control over the Information you share with us.


  • ACCESSING AND CORRECTING YOUR INFORMATION

  • You can review and change your Information by logging into the Website and/or the App and visiting your account profile page.


    You may also send us an e-mail at boop@sploot.tech to request access to, correct or delete your Information or any portion of such Information. However, any such correction and/or modification is subject to the Company’s internal policies and the applicable law.


    However, please note that your copies of your Information may remain viewable in cached and archived pages or might have been copied or stored by third-parties which Information may not be in our control.


    Please note that if your personal data has been provided to us by a third party, you should contact such party directly to make queries, feedback, and access and correction requests to us on your behalf.


    Please further note that if you withdraw your consent to any or all use of your personal data, depending on the nature of your request, we may not be in a position to continue to provide its services to you or administer any contractual relationship in place, and this may also result in the termination of any agreements with us and your being in breach of your contractual obligations or undertakings, and our legal rights and remedies in such event are expressly reserved.


  • PROMOTIONAL OFFERS FROM THE COMPANY

  • If you do not wish to have your e-mail address/contact information used by the Company to promote our own or third-parties' products or services, you can opt-out by sending an email to boop@sploot.tech stating your request. However, such opt-out request will be subject to the applicable law and the Company’s internal policies.


  • DATA SECURITY

  • The security and confidentiality of your personal data is extremely important to us. We have and we shall continue to use reasonable physical, technical and administrative methods commensurate with industry practice and the applicable law including the Information Technology Act, 2000 to secure your Information from any loss, theft, or unauthorized access, use, alteration and disclosure. From time to time, we review our security procedures in order to consider appropriate new technology and methods. 


    Please be aware though that, despite our best efforts, no security measures are perfect and impenetrable, and no data transmissions over the web can be guaranteed 100% secure. The safety and security of your information also depends on you. Consequently, we cannot ensure or warrant the security of any information you transmit to us and do so at your own risk. In connection with the same, we advise you to observe certain best practices in relation to the information deemed confidential and private by you including your passwords. 


    If we collect information from your computer, we encrypt it while it’s being transferred to us. Once the information reaches our secure servers, as part of our security program, we employ standard procedures and safeguards, such as maintaining firewalls and having an intrusion detection system, to protect the confidentiality, security and integrity of the information we maintain.


    However, as with any information travelling over the internet and kept in servers, we cannot guarantee absolute security. When we work with third parties, we require that they maintain the confidentiality, security and integrity of the information and commit that the information is not used for any prohibited purpose. Additionally, we use commercially reasonable computer security safeguards to protect our databases and servers against risks of loss, unauthorized access, destruction, misuse, modification, or inadvertent or improper disclosure of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store personal data. We restrict access to personal information to our employees, contractors and agents who need to know that information in order for us to provide, develop or improve our Services. Security risks, however, cannot be completely eliminated and we therefore cannot guarantee complete security. If you send us an email, you should know that email is not necessarily secured against interception. Therefore, if your communication will include sensitive information like your bank account, charge card, or social security number, and you prefer not to transmit it electronically, please contact us by postal mail or telephone rather than email. We do not send emails asking for a user’s username and password or its windows username and password or any other username or password.


  • GRIEVANCE REDRESSAL MECHANISM

  • We offer our users a comprehensive grievance redressal mechanism in relation to their privacy concerns on the Website/App. You can address your concerns related to this Policy or our privacy practices by sharing your relevant details which include your name, age, date of birth and the concern and the same can be emailed at boop@sploot.tech. 


  • GOVERNING LAW AND JURISDICTION

  • This Policy shall be governed in all respects by the laws of India. To the fullest extent permitted by applicable laws, you hereby expressly agree that any proceeding arising out of or relating to this Policy shall be instituted in courts in New Delhi, India.
